Use of the Service

Lyvit is a platform that allows users to discover venues and places, use location-based features, create accounts, save favourites, submit reviews, upload photos, use review tags, create profile information, and interact with related content and services.

Some parts of the service may be available without creating an account, while certain features require registration or login. Users may sign in using email login, magic link, or third-party login providers such as Google or Apple.

Limitations of Use

By using this website or any related services, you warrant on behalf of yourself and any party you represent that you will not:

• Modify, copy, prepare derivative works of, decompile, or reverse engineer any materials, software, or features contained on this website or service;
• Remove any copyright, trademark, or other proprietary notices from any materials or software on this website or service;
• Transfer, mirror, frame, or reproduce the service on any other server or platform without authorization;
• Knowingly or negligently use Lyvit in a way that abuses, disrupts, damages, or interferes with our systems, networks, security, or users;
• Use the service to submit, transmit, or publish unlawful, fraudulent, misleading, abusive, harassing, defamatory, obscene, or otherwise harmful material;

• Infringe the privacy, publicity, intellectual property, or other rights of any third party; or
• Use the service in any way that may harm Lyvit, its users, venue partners, or the integrity of the platform.

Account Registration and Security

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you believe your account has been accessed without authorization, you must notify us promptly.

We reserve the right to suspend, restrict, or terminate accounts that contain false information, are used in breach of these Terms, or create risk for the service or other users.

Business Accounts and Venue Profiles

If you use Lyvit on behalf of a business or claim, manage, or edit a business or venue profile, you represent and warrant that you are authorized to do so and that the information you provide is accurate, complete, and not misleading.

We reserve the right to verify, restrict, remove, or revoke business account access, profile control, or venue claims at our discretion, including where we reasonably believe that a claim is unauthorized, inaccurate, abusive, deceptive, or otherwise inconsistent with the integrity of the platform.

Intellectual Property

The intellectual property in the materials, content, branding, software, design, and features contained in Lyvit are owned by or licensed to Skywall management s.r.o. and are protected by applicable copyright, trademark, and other laws.

We grant users a limited, non-exclusive, non-transferable, revocable license to access and use the service for personal, lawful, and non-commercial use, unless we expressly agree otherwise in writing.

This license does not transfer any ownership rights and may be terminated at any time if you breach these Terms.

User Content, Reviews, Photos, and Account Deletion

By submitting reviews, photos, tags, profile information, or other content to Lyvit, you confirm that you have the necessary rights to submit that content and to allow us to use, host, store, display, reproduce, adapt, moderate, and distribute it within the service and for related operational and platform purposes.

You remain the owner of your content, but you grant Lyvit a non-exclusive, worldwide, royalty-free license to use that content in connection with operating, improving, and protecting the service.

You are solely responsible for the content you submit. You agree that your content will not violate applicable law, these Terms, third-party rights, or our platform rules.

We may review, remove, restrict, or moderate content at our discretion if we believe it violates these Terms, applicable law, third-party rights, or our platform rules, or if we consider removal necessary to protect the service, our users, or other affected parties.

If you delete your account, we may delete or de-identify personal information associated with your account. However, certain content or activity data, including reviews, photos, favourites, tags, and search history, may remain in anonymized or de-identified form where reasonably necessary for analytics, service continuity, moderation history, platform integrity, legal compliance, fraud prevention, dispute resolution, or legitimate operational purposes.

Where reviews or photos remain available after account deletion, we may remove or sever the direct association between that content and your deleted account.

Profile Information

Lyvit may allow you to create or maintain a public or semi-public profile, including a username, profile image, and short biography or account description.

If you choose to make profile information visible within the service, other users may be able to view it. If you upload a profile image or import one through Google or Apple login, that image may be stored and displayed as part of your profile unless you change or remove it.

You are responsible for ensuring that your profile information does not infringe the rights of others or violate these Terms.

Third-Party Services and Links

Lyvit may use or link to third-party services, tools, login providers, maps, content, or websites. We are not responsible for the content, availability, security, or practices of third-party services or websites.

Your use of third-party services may also be governed by their own terms and privacy policies.

Service Availability and Accuracy

We aim to keep Lyvit available, useful, and up to date, but we do not guarantee that the service will always be uninterrupted, error-free, secure, complete, accurate, or suitable for your purposes.

Venue information, user content, reviews, tags, rankings, search results, and recommendations may change over time and may contain inaccuracies, omissions, or outdated information. You use the service at your own risk and should exercise your own judgment when relying on content or venue information.

Liability

To the fullest extent permitted by law, Lyvit and Skywall management s.r.o. provide the service on an “as is” and “as available” basis and disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the fullest extent permitted by law, neither Lyvit, Skywall management s.r.o., nor its officers, employees, contractors, affiliates, licensors, or suppliers will be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, or for any loss of profits, revenue, data, goodwill, reputation, business opportunity, or anticipated savings arising out of or in connection with your use of, or inability to use, the service.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

Indemnity

You agree to indemnify, defend, and hold harmless Skywall management s.r.o., Lyvit, and their officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:

• Your use of the service;
• Your content;
• Your breach of these Terms;
• Your violation of applicable law; or
• Your infringement of any third-party rights.

Right to Terminate

We may suspend, restrict, or terminate your access to Lyvit or any part of the service at any time, with or without notice, if we reasonably believe that you have breached these Terms, violated applicable law, infringed the rights of others, created risk for the service or its users, or otherwise used the service in an abusive, harmful, or unauthorized manner.

You may stop using the service at any time. Where account deletion is available, you may also request or initiate deletion of your account in accordance with the options made available in the service or through our support channels.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed to the extent necessary, and the remainder of these Terms will remain in full force and effect.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Czech Republic.

You agree that the courts of the Czech Republic will have jurisdiction over any dispute arising out of or in connection with these Terms or the use of the service, unless applicable law provides otherwise.
